Terms & Conditions of Service + Privacy Policy

Client Agreement to the Terms & Conditons of Service is Implicit and Contingent upon Enrollment in Superba Vox's Online Classes and Services.

The terms of service clearly disclose the services provided by Superba Vox Inc. (“Superba”) to the student named below (“Student”). By participating in a free trial service or paying for Services, Student agrees to the following terms of service:

1. Definitions

“Student” shall be any person who seeks information about Superba Vox’s services, regardless of if the person ever pays for such services. “Service” and “Services” shall be any online lesson, instruction, tutoring, or other education provided by Superba Vox, its agents, contractors, or assigns.

“Online Platform” shall mean online video conferencing services. Example (Zoom, Google Duo, FaceTime, Skype, etc.)

2. Representation of Superba Vox

Superba Vox shall: Provide an Online Platform to provide Services; Provide the information to access the Online Platform before the scheduled Service; Exercise reasonable diligence when hiring teachers, employees, and contractors; Notify the Student of the reason for cancellation as soon as possible; and Remain dedicated to the diversity of its employees, agents, and contractors.

3. Representations of Student

Student warrants they: Agree to Superba Vox’s privacy policy posted on superbavox.com; Have provided true and accurate name, address, email, and phone number; Are an authorized user for the payment method on file with Superba Vox; Have permission to use the payment method on file to pay Superba Vox; Shall not contact any Services provider except through Superba platform; Understand that Superba Vox utilities a third-party payment system (Square), and they agree to the payment system’s terms and conditions; Will treat all Superba Vox’s employees, agents, and contractors fairly and with respect;

4. No Guarantee

The Services provided by Superba Vox are not guaranteed. By utilizing the Services, Superba Vox will use reasonable efforts to provide quality services. The Student acknowledges that there may be different methods or theories of teaching and shall not hold Superba Vox liable if it utilizes a unique methodology. Superba Vox does not guarantee that any method from its teachers will automatically lead to Student advancement or success.

5. Refund Policy

All Services must be booked and paid for in advance. Services canceled less than 24 hours before the scheduled Service shall not receive a refund. Any Service canceled 48 hours before scheduled Service shall receive a 50% refund. Any Service canceled more than 48 hours before the scheduled Service shall be entitled to a full refund. Notwithstanding, if an offer code, discount on a full-price service, or discounted lesson packages the total purchase price is non-refundable.

6. Limitation of Liability

Superba Vox shall not be liable for any security breach of its payment processor; any breach by the processor shall be the processor's sole responsibility. Superba Vox shall be liable under this agreement to Student for any incidental, consequential, special, indirect, exemplary, remote, speculative, or similar damages in excess of compensatory damages arising in connection with the Services. Superba Vox’s compensatory damages liability shall be limited to the total amount paid by Student to Superba in the last three (3) months.

7. Headings

All section titles, headings, or captions contained herein are for convenience only and shall neither be deemed a part of nor affect the meaning or interpretation of this Agreement.

8. Binding Effect

This Agreement shall inure to the benefit of binding upon the successors and permitted assigns of the parties hereto.

9. Governing Law and Jurisdiction

This agreement shall be interpreted, contused, and enforced according to the State of Michigan laws. Parties agree to the exclusive jurisdiction of the state and federal courts of Wayne County, Michigan.

10. Mandatory Pre-Lawsuit Mediation

Parties must attempt Alternative Dispute Resolution (ADR) through the Wayne County Dispute Resolution Center before either party may file a lawsuit. A party can file for ADR by visiting WCRDR.org. If, after filing, the responding parties do not agree or respond to the request for ADR, the filing party may file a lawsuit. If the responding party responds, the dispute must be handled by ADR. In the event the parties are unable to agree on a third- party neutral, the Wayne County Dispute Resolution Center shall appoint a neutral.

11. Entire Agreement

This Agreement constitutes the complete agreement among the parties hereto pertaining to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings of the parties in connection therewith.

12. Waiver

No failure of either party to assert or enforce the rights or remediates hereunder shall be construed as a waiver of such rights or remedies.

Superba Vox's Privacy Policy

Superba Vox Inc. is a virtual learning academy that provides students from across the globe one-to-one lessons in music, wellness, business, tutoring, language, and arts & crafts.

This Privacy Policy explains Superba Vox!s practices, including the information Superba Vox collects, how Superba Vox uses the information to improve your user experience, and what choices you have about the collection and use of your personal experience. (viii) Your video recordings of public events and recitals you enrolled into.
 

2. Cookies
Superba Vox collects usage information about you when you visit Superba Vox!s website. This information helps Superba Vox understand how you are navigating its site, how many visitors arrive at specific pages, the length and frequency of your stay on each page, and so on. The webpages you visit may place "cookies” on your personal computer. "Cookies” are small identifiers that help Superba Vox recognize you if you visit Superba Vox!s websites again. Cookies are not used to run programs or deliver viruses to your computer.

You may be able to modify your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis. Superba Vox also uses a temporary cookie to help determine how consumers travel through its website. A temporary cookie expires when you close your browser.

This website also uses third-party analytics tools (such as Google Analytics) to collect information such as how often users visit this site, what pages they visit when they visit, and what other sites they used before coming to this site. Superba Vox uses this information only to improve its sites. Such tools use permanent cookies to identify you as a unique user the next time you visit this site; no one but Superba Vox can use the cookies. Third parties providing such analytical tools may also transfer this information to other third parties as required by law or where such third parties process the information on its behalf. Third-party analytics providers cannot associate your IP address with your personally identifiable information.

2. Children!s Online Privacy Protection Act

Children under the age of 13 may utilize Superba Vox!s services. During the registration process, Superba Vox may ask fate child to provide certain information for notification and security purposes, including a parent or guardian's email address, the child's first name, gender identification, the child's member or account username, and password. Superba Vox may ask for birth dates from children to validate their ages. Superba Vox will not require a child to provide more information than is reasonably necessary to participate in lessons. If Superba Vox needs personal information from the child, COPPA requires that Superba Vox to seek parent/guardian consent by email. In the email, Superba Vox will explain what information it is collecting, how it will be used, how the parent can consent, and how the parent can revoke consent. If Superba Vox does not receive parental consent within one week, Superba Vox will delete all parent and child information associated with the activity.

Consistent with COPPA requirements, on any child-targeted site or application, or in any instance where Superba Vox asks for age and determine the user is age 12 or under, we will ask for a parent or guardian email address before we collect any personal information from the child. A child's personal information may only be shared with third parties (a) for a contract teacher to provide lessons to the child or (b) as permitted or required by law (ex: in response to a subpoena).

3. How Do You Protect My Information?

Superba Vox takes the security of your personal information extremely seriously and has implemented safeguards to protect it, both online and offline. Online, all information you share with Superba Vox is encrypted using security standards and procedures and safeguarded by several firewalls and password protections. Offline, Superba Vox stores your personal information in secured servers and locked rooms. Superba Vox requires any third-parties which may provide support to Superba Vox in its normal course of business to take reasonable efforts to protect your information as well.

Superba Vox continually evaluates new technology and security measures to ensure Superba Vox is taking adequate measures to protect your information.

4. How Do You Use My Information?

Your information is used to:
Process or complete a transaction;
Market Superba Vox's products or services;

Comply with any law, regulation, or court order;
Help Superba Vox improve its website or products or services it is offering;
Better understand Superba Vox's customers' needs;
